Trademark Registration
A strong trademark creates an identity, builds trust, distinguishes you from the competition, and makes communication between producer and buyer simpler. A trademark is only protected when it has been entered in the trademark register.
A trademark is always protected only for the classes of goods and services for which it is registered. You must decide definitely for which products you want to register and use the trademark when applying.
A trademark is protected for 10 years from the date of filing. In other words, protection already begins when you submit the application. Protection, once obtained, can usually be renewed every 10 years for as long as desired.
In Turkey, trademarks can be protected two ways:
- You can register trademarks nationally with protection in Turkey, or
- If your trademark is already registered abroad, you can have protection extended to Turkey (international trademark). The World Intellectual Property Organization (WIPO) is responsible for registering and administering international trademarks.
Under the Madrid Protocol, since October 2004 you can file one application to cover over 100 signatory countries, including the UK, EU and the US. This gives you global trade mark protection.
Trademark Watch Service
Registering a trademark is the first step, but it is not enough: the rights obtained through the registration may need be defended against third parties and counterfeiters.
Watch service is prepared to alert you to potentially conflicting trademark applications and registrations as they are published for opposition and cancellation purposes in official gazettes throughout the world.
Trademark Opposition
Opposition refers to an attempt to prevent a published trademark application from being registered. You might want to challenge someone else’s right to obtain a registration, or someone else might challenge one of your applications. Cancellation refers to an attempt to cancel an existing trademark registration.
